TRIBE Run For Love Namibia | Terms and Conditions

It is important that you read these terms and conditions carefully as they, together with your booking confirmation and any information that we brought to your attention before reserving your place, form the contract between you and TRIBE. 

1     ARTICLE 1: THE EVENT

1.1 ‘TRIBE Run For Love’ is a rough country footrace (the ‘Event’) taking place in Namibia (the ‘Host Country’). The Event is operated by Rat Race (Events) Limited, a company registered in Scotland, with registration number SC259949 (the ‘Event Organiser’). The Event takes place over eight days spanning approximately 225 km between 26 October 2024 to 2 November 2024.

1.2 Subject to the Conditions of Entry set out in Article 3, anyone over the age of 18 years of age can participate in the Event. 

1.3 The concept of the Event is simple: each day, individuals leave the starting line and “navigate” through a number of checkpoints to the finishing line of each stage of the Event. Participants must provide all their own gear, clothing and food when specified, and will be provided with a ration of water. Participants will be supported by professional medical and operations teams. Otherwise, no outside assistance is permitted. Individuals can finish or pull out of the Event at any time. 

2     ARTICLE 2: GENERAL

2.1 These Terms and Conditions govern entry into the Event.

2.2 You must read these Terms and Conditions carefully prior to registering for the Event. You may only register and enter the Event if you have read, understood and agreed with these Terms and Conditions . Once TRIBE has accepted your online application form and the Event deposit fee, you have entered into a legally binding agreement with Everyday Adventures Limited (trading as TRIBE), a company registered in England, with registration number 09286289, (referred to in these Terms and Conditions variously as “TRIBE”, “the Company” “we“, “us“, and “our“). 

2.3 Every participant must sign a copy of these Terms and Conditions, together with the Liability Waiver  before being permitted to participate in the Event. In addition, every participant must sign the mandatory forms, as specified by TRIBE, and provide all required information, including but not limited to, the participant’s emergency contact information and medical information.

2.4 Every participant must read and accept the terms issued by the Event Organiser and comply with these. You can find the terms here. If there is any conflict between these terms and the Event Organiser's terms, these Terms and Conditions will take precedence.

2.5 TRIBE and our designated Event Organiser have complete discretion in applying these Terms and Conditions. These Terms and Conditions may be modified by TRIBE at any time without notice. The revised Terms and Conditions will be posted on the Event website (www.triberunforlove.com) (the ‘Website’) as soon as reasonably practicable. The Terms and Conditions will be posted and amended from time to time. Participants will be solely responsible for familiarising themselves with the most up-to-date version of these Terms and Conditions of the Event at any given time.

3     ARTICLE 3: CONDITIONS OF ENTRY

3.1 TRIBE reserves the right, in its sole discretion and at any time, to refuse to allow you to enter into or participate in the Event, or to withdraw or cancel your offer of a place in the Event from you. TRIBE is under no obligation to provide you with any reason whatsoever for such refusal or withdrawal. TRIBE may also (but is under no obligation to) offer you a place in another edition of the Event in circumstances where entry into or participation in the Event has been refused.

3.2 You must be 18 years of age or older by the Event start date to participate in the Event. You may request special permission to participate in the Event if you are under the age of 18. All requests will be assessed on an individual basis and the decision of TRIBE in this regard is final and binding.

3.3 You acknowledge and agree that the Event takes place in a semi-remote area of the world, where everyday facilities and comforts to which you may be accustomed are unlikely to be available. You are expected to possess basic outdoor survival skills such as familiarity with outdoor gear, backpacking and common sense.

3.4 You acknowledge and agree that participating in the Event will be physically demanding, and that you are aware of the nature of the Event and that there are medical and physical risks associated with the Event. You are solely responsible for your own training and preparation for the Event. By applying to participate in the Event, you warrant that you are physically capable of participating in the Event and agree that (subject to Article 8 below) TRIBE, its officers, employees, agents, affiliates, third party event partners and/or medical advisers are not responsible or liable in the event of your death, or for any injury or illness that you may suffer as a result of or in connection with your participation in the Event.

3.5 You acknowledge and agree that you are responsible for obtaining and taking all necessary vaccinations and medications (and have taken them in accordance with your doctor’s instructions) relevant to the Host Country. You also acknowledge that it is your sole responsibility to carry your personal medications with you throughout the Event. The Event Organiser’s medical support staff will not be able to, nor will it be liable for failing to, supply personal medication during the Event should a participant fail to carry their own.

3.6 You acknowledge and agree that an endurance challenge of the kind contemplated by the Event entails the real risk of serious injury or even death from various causes including equipment failure, dehydration, fatigue, collisions or incidents involving other participants, spectators, other road users and/or vehicles, aspects of the course or bad weather conditions and other causes.

3.7 You agree to inform TRIBE and the Event Organiser, prior to the Event, of any pre-existing illness from which you suffer that may affect your performance in the Event or for which medical treatment may be needed. In addition, you agree to inform TRIBE and the Event Organiser, both on application and thereafter, as the need arises, of all medications that you are currently taking or will be taking while you are participating in the Event.

3.8 Professional medical support will be provided to participants throughout the duration of the Event. You give permission to medical support staff to make decisions concerning medical care and treatment, and where necessary to authorise such care and treatment in emergency situations. You understand that Event staff will make every reasonable effort, in the circumstances, to reach your emergency contact (if you have supplied one to us prior to the Event) regarding your medical status in the event an emergency arises.

3.9 You acknowledge that the Event operates in semi-remote areas of the Host Country which may not be supported by local hospitals, and that transportation to the nearest hospital may take several hours or longer. You further acknowledge that the course may pass through terrain such as remote deserts where emergency evacuation may be seriously delayed or in some cases not available.

3.10 By agreeing to these Terms and Conditions and applying to participate in the Event, you affirm that you have the understanding and mental capacity to communicate health care directives for yourself and that you are fully informed and understand the full import of the consents given by you to medical support staff in this regard.

4     ARTICLE 4: CODE OF CONDUCT & EVENT RULES

4.1 For reasons of fairness, safety and responsible behaviour, you are expected to abide by the Event rules and regulations set out in this Article. Failure to comply with these Event rules and regulations may lead to penalties or disqualification from the Event. You understand and accept that failure to comply with any of these terms and conditions (including the Event Rules) or the health and safety rules of the Event may, at TRIBE’s sole discretion, result in your disqualification from the Event. In such circumstances you may be asked to leave the Event site/location and cancellation charges will apply.

4.2 You must immediately and respectfully comply with any direction or decision of the TRIBE, the Event Organiser and the medical support staff. Any failure to do so may result in the disqualification of you from the Event. 

4.3 It is your sole responsibility to comply at all times during the Event with all applicable laws, byelaws and regulations, including without limitation, all speed regulations, road traffic laws (including the Highway Code and such local requirements that may be in place) and laws relating to the possession or use of alcohol, drugs or other prohibited substances. 

4.4 You must, at all times throughout the Event in which you are participating, abide by the Host Country’s laws, and behave in a respectful and considerate manner to local people, and to other people involved in the Event (including fellow participants, TRIBE staff, the Event Organiser and medical support staff).

4.5 Your behaviour throughout the Event must not prejudice the progress of the Event, or the safety or well-being of any other person involved in the Event (including fellow participants, the Event Organiser and the medical support staff).

5     ARTICLE 5: ENVIRONMENTAL RULES

5.1 The Event takes place in a pristine area of the world. It is therefore imperative that participants leave no trace and show respect for the environment, landowners, local communities and other recreational users. The rules in this Article  apply to everyone associated with the Event, including participants, staff, volunteers, media crewand sponsors.

5.2 Litter - Absolutely no litter of any kind, including for example water bottles, caps from water bottles, energy bar wrappers shall be left on the course or in the tents provided. If you are found to have littered the course you will be disqualified from the Event at the sole discretion of TRIBE and the Event Organiser. All litter is to be carried to the closest transition or checkpoint for disposal.

5.3 Tread Lightly - If you encounter plant foliage, do not step on it. Do not pick flowers, cut walking sticks from or otherwise damage the vegetation. Do not light any fires along the course (campfires will be provided in the campsites where possible by the Event Organiser). If there are unique rock formations, do not touch, disturb or deface the rocks. If you encounter any unique rocks, ancient ruins or fossils, do not remove them from their location.

5.4 Campsites - Where the event involves a campsite, basic camping techniques shall be employed. Leave no trace at your campsite. No chairs or other furniture around the campfire may be taken into or around the tents provided. You must sleep either in your assigned tent or otherwise within the inside perimeter of the camp compound.

5.5 Toilets - When at a campsite, you must use the toilet facilities provided. When out on the course, all human waste and toilet paper must be buried between 15 and 25 cm below the surface and at least 100 metres from a checkpoint, campsite, course, residential home, or ancient ruin.

5.6 Any breach whatsoever of these Terms and Conditions will result in disqualification, at the discretion of TRIBE and the Event Organiser.

6     ARTICLE 6: BOOKINGS AND PAYMENT

6.1 To participate in the Event, you must first:

(a) Complete the registration form on the Website and submit the form online;

(b) Pay the  deposit, 50% of the total registration fee), for the Event in accordance with the instructions given on the Website (you will not be eligible to participate in the Event until we have received full payment of the registration fee and the funds have cleared by 1 April 2024);

(c) Sign and submit to us the Liability Waiver;

(d) Complete and return all of the mandatory forms as specified by TRIBE and the Event Organiser either to you directly or as detailed on the Website. TRIBE reserves the right to withdraw the offer of a place in the Event and (if already received) not refund you the entry fee for the relevant Event if it does not receive the documentation specified in 6.1 within 14 days of the start date of the Event.

6.2 You are solely responsible for obtaining and complying with all specific passport, visa, health and immigration requirements associated with travelling to and entering the Host Country and participating in the Event. You should check and confirm the latest relevant passport, visa, health and immigration requirements with the relevant Consulate/embassy for the Host Country. You should also check with your doctor for details on any health measures you will need to take prior to the start date of your Event.TRIBE does not accept any responsibility for, and will under no circumstances be liable (including, without limitation, for providing a refund of the entry fee for the Event) if you cannot travel to the Host Country for any reason, including without limitation your failure to obtain a visa, or if you are otherwise unable to participate in the Event because of your non-compliance with any passport, visa, health or other immigration requirements. You agree to reimburse us for any fines, damages, losses, costs and expenses (including legal costs and expenses) which we incur due to your failure to comply with any applicable passport, visa, immigration or health requirements.

7     ARTICLE 7: WITHDRAWAL, CANCELLATION OR ALTERATION

7.1 You may withdraw from the Event at any time, subject to the following provisions of this Article:

(a) If you withdraw more than 120 days before the start date of the Event you will receive a refund of the entry fee for the Event, less the deposit. The deposit is non-refundable. 

(b) If you withdraw from the Event less than 120 days before the start date, TRIBE will not be liable to refund you any portion of the entry fee for the Event, or otherwise pay you any sum whatsoever, although it may choose to do so. 

7.2 You agree that entry to the Event is granted to participants on a non-changeable, non-transferable basis, unless you have consulted with TRIBE in advance and this has been approved in writing by TRIBE and the Event Organizer. 

7.3 TRIBE reserves the right to withdraw the offer of a place in the Event to you for any reason and at any time. In such circumstances, we will provide you with a full refund of the entry fee for the Event.

7.4 TRIBE reserves the right to:

(a) Modify the Event format; (b) change the dates of the Event; and/or (c) cancel the Event. 

We will only exercise these rights due to circumstances beyond our reasonable control (including, without limitation, war, riot, industrial dispute, terrorist activity and its consequences, changes in immigration or entry controls, natural or nuclear disaster, fire, epidemics or health risks, closed or congested airports, ports or stations, changes imposed by rescheduling or cancellation of transport by the transport supplier such as flights by airlines or main charterers, the alteration of transport or transport types, adverse weather conditions (actual or threatened), and technical failure with transport).

7.5 If we change the dates of the Event in accordance with Article 7.4 (b), we will have no obligation to reimburse you any part of the entry fee for the Event provided that we reschedule the Event to commence on another date within 12 months from the date on which the Event was originally scheduled to commence, and provided that we give you reasonable notice of the new dates for the Event (which will in any case not be less than two months). We will not, under any circumstances, be responsible for travel or associated expenses, or any other losses you incur as a result of the Event Date changing other than as is set out in this Article 7.5. 

7.6 If we cancel the Event in accordance with Article 7.4 (c), we will endeavor to reimburse you the entry fee for the Event in full other than where TRIBE has incurred costs and expenses that it is not able to recover itself.

7.7 Except as set out in Articles 7.5 and 7.6, TRIBE will not have any liability to you for the rescheduling or the cancellation of the Event.

8     ARTICLE 8: LIMITATION OF LIABILITY

8.1 Nothing in these Terms and Conditions excludes or limits TRIBE’s liability for:

(a)  fraud; (b) death or personal injury caused by negligence on the part of TRIBE; or (c) any other liability which cannot be excluded or limited by the law.

8.2 Subject to the provisions of Article 8.1, neither TRIBE nor the Event Organiser will be liable to you for:

(a) any loss of or damage to your equipment and belongings;

(b) any indirect or consequential loss; or

(c) any loss or damage suffered or incurred by you arising out of or in connection with participating in the Event (including, without limitation, travelling to the Host Country and Town/City).

8.3 Except as otherwise provided by any applicable laws, TRIBE and the Event Organiser’s maximum liability to you for any claim in contract, tort, or in any other cause of action arising out of or in connection with the Event will not exceed the entry fee for the Event.

9     ARTICLE 9: INSURANCE

9.1 It is a condition of booking that you have adequate insurance in place which covers your participation in all activities/locations included in your Event and your rescue/return should you come into difficulty during your participation.

9.2 The minimum your insurance policy must cover you against is: a) the cost of cancellation made by you; b) the cost of assistance (including repatriation* and search and rescue) in the event of accident (including injury/catastrophic injury), illness or death (including, in the worst case scenario, recovering mortal remains); and loss of or damage to baggage/equipment.

*The level of repatriation cover must be sufficient to ensure that you can be returned home regardless of the position you may be in and must take into consideration the location/hazards of the Event. 

9.3 TRIBE has no control over, and accepts no responsibility for, the availability or standard of medical and/or repatriation services and facilities in the areas in which the Event takes place, and such services and facilities do not form any part of the contract between you and TRIBE.

9.4 You are solely responsible for your own equipment and belongings during the Event and bear the sole responsibility for incidental or accidental damage (including wear and tear) to, or loss of, your own equipment and belongings. 

9.5. If you chose to participate without adequate insurance cover in place, we will not be liable to you for any losses howsoever arising where cover would otherwise have been available (except where these are incurred as a result of our negligence).

10     ARTICLE 10: INTELLECTUAL PROPERTY, MEDIA CONTENT AND DEVICES

10.1 You acknowledge and, so far as is necessary under applicable laws, consent to being photographed or filmed by TRIBE and/or any third parties appointed thereby, which shall have the right, in perpetuity or for the maximum term permitted under applicable laws, to use, broadcast, publish and license, without any requirement for payment of money or other form of consideration and without credit, your voice, image and likeness, by means of live or recorded video and/or audio display, broadcast or other transmission or recording, photographs or any other current and/or future media technologies. 

10.2 You accept and acknowledge that it is in TRIBE’s legitimate interest to use and publish and exploit the content detailed in article 10.1 in this manner (including any personal data contained therein) as it requires the ability to: a) publish, display, sell and distribute the Event by means of film, television, radio, print media, internet, publicity material (or another other media); and b) use the images for its promotional, training or marketing or fundraising purposes, as determined in TRIBE’s sole discretion (including use by commercial partners, TRIBE Freedom Foundation and any accredited media partners). Notwithstanding the foregoing, where required under applicable laws, you give your irrevocable consent to such use. 

10.3. If you wish to engage a third party for the purpose of commercial filming, photography and/or collecting photographs of you at the Event, you must request our written consent prior to the Event.

10.4. You are welcome to take photographs, film footage and create imagery of your participation in the Event for non-commercial purposes (that is for personal and private use only). No written permission is required for the publication of personal images on social media sharing websites such as Facebook and Instagram.

10.5. You are NOT permitted to reproduce or use photographs, film footage or Imagery of the Event taken by you for any commercial purpose (including, but not limited to, on websites, in any printed media or matter or in any television programme) without first obtaining our prior written consent.

10.6.  Where paragraphs 10.3 – 10.5 apply, you agree to make all Imagery obtained by you available for us to use, without charge, for the uses outlined in paragraph 10.1. We shall, in our sole discretion, decide whether or not to use the Imagery for these purposes. Your right to withdraw your consent to our using your Imagery shall apply equally to Imagery obtained by you.

10.7 TRIBE may, if reasonably practicable, provide wireless Internet access at the campsite to ensure communications and live website coverage. You are only allowed to use the wireless Internet access in areas designed by Event staff. Access to any Internet sites during an Event except those explicitly approved by the Event Organiser is prohibited. Nothing in this Article will oblige TRIBE to provide wireless Internet or laptop computers at any or all of the checkpoints or campsites. 

10.8 You may use your own power sources to charge your personal mobile devices such as cameras and iPods. You may not, under any circumstances, use any of the power sources utilized by the Event staff or volunteers to operate the Event to charge your personal devices.

11     ARTICLE 11: THE COURSE

11.1 TRIBE and the Event Organiser reserve the right to add, modify, cancel or change the course at any time.

11.2 While participating in an Event, you must stay on the course. If you inadvertently leave the course, you must re-enter the course at the exact place where you left the course. If you intentionally cut or leave the course (as we or the Event Organiser may determine in our sole discretion), you may be disqualified.

11.3 The course may be changed due to weather, safety hazards or darkness and we or the Event Organiser may in our absolute discretion adjust stage finish times to reflect any course changes.

11.4 Mandatory stops may be issued at any time due to climate, weather conditions or other factors. You must stay at the checkpoint indicated as a mandatory stop for the full-time indicated. Failure to do so will result in disqualification from the Event.

11.5 Staggered starts may be issued for any stage of an Event. Staggered starts are used to ensure that checkpoints are not kept open for unreasonable amounts of time. You will be notified of staggered starts before the beginning of the relevant stage of the Event. Any request to begin a stage of the Event at a start time other than the one assigned to you must be approved by the Event Director.

11.6 When using GPS, you must follow the designated course. You may not travel directly between checkpoints unless the logical or obvious course follows the straight line route. Cutting the course is against these Terms and Conditions and may, in addition to disqualification, may lead to dead ends or impassable terrain.

12     ARTICLE 12: UNIFORM

TRIBE may have sponsors for the Event. You will not be allowed to have your own sponsors that conflict with TRIBE sponsors.

13     ARTICLE 13: EQUIPMENT

13.1 The Event has its own specific mandatory equipment/kit requirements. These will be detailed on the Event website in the FAQs section before you book and will be confirmed to you in writing in advance of the Event. We reserve the right to make changes to mandatory equipment/kit requirements up to 24 hours before the start of an Event. Any such changes will be notified to you by either e-mail, text and/or by posting a notice on the Event website. Note: you will be required to demonstrate to the Event Organizer at the start of the Event that you have the required mandatory equipment/kit with you.

13.2 It is your sole responsibility to ensure that you have the required mandatory equipment/kit (including specific safety equipment) before you enter the Event and with you at all times during the Event. This is essential, as without it you will not be able to participate in the Event safely and will not be permitted to enter and participate in the Event. Note: in these circumstances you waive your right to participate in the Event and we shall have no liability to you to refund your participation fee or any costs/expenses (including legal costs and expenses), damages, compensation and losses incurred by you as a result of your failure to meet the mandatory equipment/kit requirements.

13.3 You must supply your own food and drink mixes for a portion of the event. Participants must start with at least the minimum number of calories stated in the mandatory equipment list. ; The Event Organiser may, at their sole direction, check a participant’s food supply to ensure that the proper amount of calories remain for the duration of the Event. The medical support staff will have the final decision as to whether the calories carried are sufficient for an individual participant.

13.4 Additional gear requirements may be required for the Event depending on expected terrain and weather conditions. You will be personally advised of these requirements by TRIBE or the Event Organiser prior to the Event.

13.5. TRIBE accepts no responsibility for loss, theft, or damage to any equipment/kit/property owned by or under the control of the participant. This includes any transport of your equipment where such transport is an element of the service provided during the Event (whether by, or on behalf, of TRIBE).

14     ARTICLE 14: WATER

The Event Organiser will supply a ration of water at each checkpoint. Water supplied is to be used for drinking only. Additionally, hot water for cooking purposes will be supplied at all campsites. 

15     ARTICLE 15: CHECKPOINTS

15.1 You will be given Course Instructions before the start of the Event. 

16     ARTICLE 16: OFFICIAL LANGUAGE

The official language of the Event is English. You are solely responsible for reading and understanding all official Event signs, directions, and oral instructions given by TRIBE, the Event Organiser and medical support team.

17     ARTICLE 17: GENERAL

17.1 You acknowledge and agree that by taking part in the Event you shall not rely on, and shall have no remedy in respect of, any statement, representation, warranty, understanding, promise or assurance (whether negligently or innocently made) of any person other than as expressly set out in these Terms and Conditions.

17.2 If any provision of these Terms and Conditions is be held to be unlawful, void, or for any reason unenforceable, then such provision shall be deemed severable from these Terms and Conditions, shall be enforced to the fullest extent allowed by law, and shall not affect the validity and enforceability of any remaining Terms and Conditions.

17.3 No waiver or amendment by TRIBE or by you of these Terms and Conditions shall be effective unless in writing and signed by both you and TRIBE .

17.4 The agreement between you and TRIBE governing the Event is made on the terms of these and Conditions. Any dispute or claim arising out of or in connection with these Terms and Regulations, or the subject matter or formation (including non-contractual disputes or claims), shall be governed and construed in accordance with the laws of England and Wales. Each party submits to the exclusive jurisdiction of the courts of England and Wales. 

17.5 In applying to participate in the Event, you hereby consent to TRIBE using all personal information collected from or about you in connection with the Event (including information collected by the Event Organiser) for the organisation, operation, administration and promotion of the Event. You further consent to your personal information being provided to others assisting TRIBE in connection with the Event. You may contact TRIBE via the contact form on the website to request access to any of the personal information relating to your collected data and held from time to time by us. The Terms and Conditions are in place to ensure a safe, fair and environmentally sound event. 

18. ARTICLE 18: CAMPING AND COURSE RULES 

**Note, three ‘warnings’ will result in Event ‘disqualification/withdrawal’. 

18.1 Litter on Course; Any litter on the course known to be dropped by you (either by identification or seen by another participant or event staff) will result in a warning. Every time this is reported, another warning will be issued. 

18.2 Litter in Tents; Any litter left in tents when they are vacated in the morning will result in every participant officially assigned to that tent being given a warning. Every time this occurs will result in a further warning. 

18.3 Sleeping Outside the Camp Compound; Participants are required to sleep in their assigned tents or within the camp compound. Sleeping outside the compound will result in a warning.

18.4 Use of Phones etc. As per the Kit List you must carry a phone. If your phone is found to be without battery and without a portable charging device a warning will be issued. 

18.5 Charging Personal Items on Event Charging Facilities; You must use your own power sources, such as solar panels or power travellers, to charge any personal items. If you are seen to be charging using event power sources (including through a USB in the laptops) a warning will be issued. 

18.6 Mandatory Stops; Failure to comply with a mandatory stop will result in a warning. For example if a participant leaves the checkpoint early from which a mandatory stop has been enforced. 

18.7 Staggered Starts; If a staggered start is put in place you must comply with the start time that has been assigned to you, based on your times thus far. Failure to comply with this, other than with approval of the event director and medical director will result in a warning.

18.8 Removing or Moving Course Markings; Any participant seen to remove or change course markings will be disqualified. 

18.9 If race numbers are used for the event and are not attached in accordance with the patch placement instructions then you will receive a warning. For each day that this is not rectified the person will be issued with a warning. 

18.10 Sponsor Logos; Sponsor logos can be worn on your clothing provided they do not conflict with TRIBE partners or sponsors and they are not obscuring your bib number. You will be given a chance to rectify / remove any sponsorship branding which does meet these requirements. Failure to remove them when asked will result in disqualification. 

18.11 Mandatory Equipment Missing (pre-race); If any mandatory item is missing in entirety or does not meet the necessary requirements during check-in (including quantity, type and calorific value of food) you will receive a warning and not be allowed to start. The participant can be given a chance to purchase or borrow the missing item but the item must be produced and shown to the event director before leaving for camp.

18.12 Mandatory Equipment Missing (mid-race); If any mandatory item is missing in entirety or does not meet the necessary requirements upon a spot check being carried out from the time the participant crosses the start line to when they cross the finish line a warning will be issued. Essential Items include: number of calories, sleeping bag, backpack, shoes, headlamp, electrolytes, Non-Essential items include but are not limited to: Blister kit, back up headlamp, alcohol gel, Sunscreen. Disqualification if it is an essential item or a warning for non-essential items

18.13 Inadequate Food; If a participant is not deemed to have sufficient calories to complete the race safely (2000 calories for each of the remaining days). Disqualification

18.14 Water – Water that is used for washing (either yourself or your clothes) or any other use except consumption will receive a warning. 

18.15 Public protest or display of disgust; Any public protest, display of disgust and/or disrespectful behaviour to any event staff will result in a warning or disqualification. 

18.16 IV Drip; The medical team is present to support the participants and this support may include the provision of an IV drip, if a doctor deems it necessary. However, if the medical doctor deems it necessary for the same participant to have a second IV drip then they will not be allowed to continue. 

**Note, three warnings will result in event disqualification from the Event at the sole discretion of TRIBE and the Event Organiser.

19. WAIVER – PLEASE READ THIS VERY CAREFULLY

19.1 You acknowledge that the Event, by its nature, terrain and/or location, is potentially hazardous and dangerous to participants and that participation carries a risk of serious personal injury and/or death to you and others and/or damage to equipment/kit/property. You are solely responsible for assessing on each occasion whether you should participate/continue to participate in an Event, and this is at your own risk. It is your personal responsibility to remain within the Run For Love Terms and Conditions at all times. You must acknowledge that you will not be under continuous direct supervision at all times. 

19.2 If you choose to take part in the Event, you commit to do so with full knowledge and understanding of the risks associated with participation in the Event. It is your sole responsibility to inform yourself of the risks involved and you are strongly advised to take every reasonable precaution to avoid such risks. It is also your responsibility to exercise reasonable care and attention whilst participating in your Event. You are expected to be able to look after yourself/other Participants included in your Event. TRIBE does not accept liability for any losses sustained by you/other participants included in your Event booking which arise out of participation in any Event (except where they arise out of our negligence).

19.3 The Event takes place outside in varied, sometimes extreme, weather conditions (often with little or no warning). You are expected and remain responsible for preparing yourself for the weather conditions of the day accordingly. We accept no liability for any losses incurred by you in these circumstances (except where they arise out of our negligence). 

19.4 You acknowledge and agree that you are fully aware of the risks, including those of serious injury or death from causes that it may or may not be possible or reasonable to identify or anticipate but including and not limited to defects in or failure of equipment; fatigue; heart failure; dehydration; hyponatremia; injury arising from incidents affecting you alone or involving other participants, staff, third party road users or vehicles; and the effects of adverse weather conditions or other causes; 

19.5 You understand and acknowledge that the type of medical facilities that you might expect elsewhere (such as in the UK) may not be available in the host country, or may not be available within a convenient distance should an injury be sustained by you or others. In addition, you accept that even an emergency evacuation may be impeded by the terrain and conditions pertaining in whatever part of the Host Country through which the Event may be run; and

19.6 You agree that it is a condition of your participation in the Event that you hold full medical insurance to provide for any costs or expenses or treatment relating to your medical needs (other than where these can be provided on the course by Event staff) including full repatriation, and you consent to submit to and abide by any decisions concerning your health and safety, medical care and treatment made at any time by the Medics and that all the Medics and other Event Organiser may make emergency decisions as to your treatment by others (such as local medical practitioners or hospitals) where necessary. Without limiting the generality of foregoing consent, you will also agree to abide by any decision the Medics or the Staff may make as to your fitness to continue your participation in the Event or whether or not you should retire on medical or fitness grounds. 

Limitation of Liability

19.7 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, or subcontractors and for fraud or fraudulent misrepresentation.

19.8 To the fullest extent permitted by law, you hereby waive, release and forever discharge us, our officers, employees, agents and representatives and all other persons associated with the Event (including but not limited to Everyday Adventures Limited, Tribe Freedom Foundation and the Event Organiser) for all liabilities, claims, actions or damages that you may have against us arising out of or in any way in connection with your registration and/or participation in the Event including, without limitation, any liability or claims caused by the action or inaction of any of the above parties, or otherwise.

19.9 You agree to indemnify and hold harmless TRIBE its officers, employees, and representatives and all other persons associated with the Event from all liabilities, claims, actions and/or damages arising out of or in any way in connection with your participation in the Event or any breach by you of the Terms and Conditions of the Event.

19.10 Except as otherwise required by applicable laws, the maximum liability to you by the Company, and any persons associated with the Event (including but not limited to the Event Organiser) for any claim in contract, tort or other cause of action arising out of or in connection with the subject matter of this Agreement (including the Event, your stay and/or any travel to or within the Host Country shall not exceed the entry fee paid by you to participate in the Event.

TRIBE Run for Love Namibia is a trading name of TRIBE .

BY PURCHASING A TICKET, THE TICKET HOLDER (YOU) AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF SALE SPECIFIED HEREIN AND ANY OTHER PROVISION AS MAY BE SPECIFIED FROM TIME TO TIME BY US, THE EVENT ORGANISER OR THE OWNER OF THE TICKETING PLATFORM (EVENTCUBE).

EVENT TICKETS ARE NON-TRANSFERABLE AND NON-REFUNDABLE EXCEPT IN THE INSTANCE OF EVENT CANCELLATION. IF AN EVENT IS CANCELLED, YOU WILL BE ENTITLED TO A REFUND OF THE TICKET PRICE LESS THE BOOKING FEES AND ANY OTHER CHARGES WHICH WE CANNOT RECOVER.

We sell paper or e-tickets (Tickets) for events advertised on websites owned and operated by us from time to time (Events) using Eventcube's 'Ticket Mechanic'. Eventcube is a trading name of Eventcube Solutions Ltd, a company incorporated in England under company number 08939283.

The party who organises and provides the Event is the Event Organiser

1. YOUR RELATIONSHIP WITH THE EVENT ORGANISER (TRIBE Run for Love Namibia)

  1. The Ticket is issued subject to the Event Organiser's terms and conditions found on its website, at the box office, or in the Terms & Conditions of entry to any on-line Event (Event Organiser T&Cs)
  2. If you breach any of the Event Organiser T&Cs or behave in an unacceptable manner (see Section 4 below), the Event Organiser is entitled to refuse you entry to the Event.
  3. The Event Organiser may alter or vary the Event due to circumstances beyond its reasonable control without being obliged to refund monies or exchange Tickets.

2. YOUR RELATIONSHIP WITH EVENTCUBE

  1. EVENTCUBE WILL NOT BE RESPONSIBLE FOR ANY REFUNDS TO TICKET HOLDERS
  2. Your use of the Eventcube website to purchase Tickets, and the transmission of your personal data to Eventcube to enable the purchase of Tickets is subject to the terms of Eventcube's privacy policy: https://www.eventcube.io/legal/privacy-policy
  3. You acknowledge that Eventcube may store and transmit your personal data in accordance with its Privacy Policy.

3. YOUR TICKETS

  1. Once your Tickets are issued (in paper or electronic form), it is your responsibility to keep them safe. We will not be responsible for Tickets which have been lost, stolen or destroyed.
  2. E-Tickets do not incur any additional charges than our processing fees, Physical Paper tickets will incur an extra printing and postage cost.
  3. The general limit for ticket purchases for an individual ticket release for an Event is 6, and this may be lowered in certain circumstances. This policy is in effect to discourage unfair ticket buying practices.
  4. Tickets may be restricted to a maximum number per person, per credit card and, for some events, a restriction may apply per household. We reserve the right to cancel Tickets purchased in excess of this number without prior notice.
  5. Multiple tickets orders cannot be split. The primary Ticket holder must be present to enter the Event with E-tickets.
  6. If you are splitting barcoded E-Tickets you may print out each barcode separately and provide the other parties with relevant identification details, however entry will be entirely at the discretion of the Event Organiser.
  7. We try and ensure that all prices on our website are accurate, however errors may occur. If we discover an error in the price of Tickets you have ordered, we will inform you as soon as possible and give you the option of reconfirming your Ticket purchase at the correct price (and credit or debit your account as applicable) or cancelling your Ticket purchase. If we are unable to contact you, you we may treat the Ticket purchase as cancelled.
  8. It is your responsibility to ensure that your Ticket purchase contains the correct information. We are not responsible for correcting information which you have provided, however we will use all reasonable efforts to remedy errors where possible.
  9. UNLAWFUL RESALE OF TICKETS IS STRICTLY PROHIBITED. IF WE REASONABLY SUSPECT THAT TICKETS HAVE BEEN PURCHASED FOR UNLAWFUL RESALE, WE MAY CANCEL THE RELEVANT TICKETS WITHOUT ANY RIGHT TO COMPENSATION OR REFUND.

4. ADMISSION TO THE EVENT

  1. The Event Organiser reserves the right to refuse admission, and to request any Ticket Owner to leave the venue (including an on-line venue) at any time for reasons of public safety. This includes, but is not limited to: (i) crowd surfing and moshing; (ii) aggressive behaviour; (iii) acting under the influence of alcohol or drugs; (iv) carrying an offensive weapon; (v) failure to comply with any measures put in place to combat the spread of Covid-19, and/or (vi) any unacceptable behaviour likely to cause damage, nuisance or injury, or for any breach of the Event Partners´ terms and conditions. You will not be entitled to a refund.
  2. A Ticket Owner may be asked to leave an on-line event for failing to observe the acceptable use policy for the relevant Event.
  3. The Event Organiser reserves the right to refuse re-admission to any person not in possession of a Ticket or the retained portion of the Ticket.
  4. Latecomers may be admitted at a suitable point in the performance at the discretion of the Event Organiser.
  5. You acknowledge that there may be security checks at any venue.

5. EVENT CANCELLATION

  1. If an Event is cancelled or rescheduled, we will use reasonable endeavours to notify YOU of the cancellation once we have received the relevant authorisation from the Event Organiser, however we do not guarantee that ticket holders will be informed of such cancellation before the date of the Event.
  2. Unless indicated otherwise in relation to a particular Event, if an Event is cancelled, you will be offered seats at the rescheduled Event/s (subject to availability) up to the face value of the Tickets or, if you are unable to attend the rescheduled Event or the Event is not rescheduled, a refund of the ticket price.
  3. Refunds for Tickets purchased prior to the date of the original Event will be given up to their face value. If an Event takes place over several days and only one day is cancelled, you will be entitled to a pro-rata refund.
  4. IF THE EVENT IS RESCHEDULED, THE EVENT ORGANISER MAY SET REFUND LIMITATIONS.
  5. Ensure you check all "Event Specific Terms & Conditions" at the top of this page for refund policies.

6. PHOTOGRAPHY & VIDEO RECORDING

  1. You must not take any unauthorised audio, video, photographic or digital recording apparatus of any kind into any of the performance areas, nor make any audio, video or photographic recordings of any kind. The Event Organiser reserves the right to confiscate any unauthorised audio, video and photographic recordings.
  2. You consent to filming and sound recording as members of the audience (at a venue or on-line).

7. LIABILITY

  1. Personal arrangements including travel, accommodation or hospitality relating to an Event which have been arranged by you are at your own risk. Unless otherwise stated in this clause, our and the Event Organiser's liability to you in connection with the Event (including, but not limited to, in the event of cancellation, rescheduling or material change to the programme of the Event) shall be limited to the Ticket price paid by you.
  2. Subject to Section 7.3, neither we, Eventcube or the Event Organiser (Event Partners) will be responsible for any loss, injury or damage to any person (including you) nor property howsoever caused.
  3. Nothing in these Terms and Conditions seeks to exclude or limit our or the Event Partners' liability for death or personal injury caused by our or the event partner(s)' (as relevant) negligence, fraud or other type of liability which cannot by law be excluded or limited.

8. FORCE MAJEURE

  1. Force Majeure Event means any circumstance not within a party's reasonable control including, without limitation:
    1. acts of God, flood, drought, earthquake or other natural disaster;
    2. epidemic or pandemic;
    3. terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relation;
    4. nuclear, chemical or biological contamination or sonic boom;
    5. any law or any action taken by a government or public authority, including without limitation imposing an export or import restriction, quota or prohibition, or failing to grant a necessary licence or consent;
    6. collapse of buildings, fire, explosion or accident; and
    7. interruption or failure of utility service.
  2. If the Store Owner is prevented, hindered or delayed in or from performing any of its obligations under this agreement by a Force Majeure Event, it shall not be in breach of this agreement or otherwise liable for any such failure or delay in the performance of such obligations. The time for performance of such obligations shall be extended accordingly.

9. DATA PROTECTION

  1. If you book Tickets with us, we will hold your name, address and other personal data in our database, subject at all times to our Privacy Policy. If you wish to make any requests regarding your personal data, please email support.

10. GENERAL

  1. The Event Partners and their affiliates, successors, or assigns may enforce these terms in accordance with the provisions of the Contracts (Rights of Third Parties) Act 1999 (the Act).
  2. Except as provided above, these Terms and Conditions do not create any right enforceable by any person who is not a party to it under the Act, but does not affect any right or remedy that a third party has which exists or is available apart from that Act.
  3. These Terms and Conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the law of England and Wales. Each party irrevocably agrees that the courts of England shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation.
